Definitions of terminology used within this document
- ‘You’ or ‘Client’ refers to any individual, business, or organization utilizing the services offered by Extropy Media.
- ‘We’, ‘us’, or ‘our’ denotes Extropy Media.
- ‘Project’ refers to any service or task undertaken by Extropy Media as requested and outlined in our confirmation email to the client.
- ‘Domain’ means the web address specified by the client.
- ‘Hosting’ refers to the annual fee required to keep a client’s website accessible online.
- ‘Content’ or ‘material’ includes all text, images, and data requested by the client for use in the project.
General Terms
- The agreement between Extropy Media and the client is governed by these terms and conditions.
- Any modification to these terms must be confirmed in writing by Extropy Media via email or post.
- Details of the project will be as outlined in Extropy Media’s order confirmation email.
Development Stages and Delivery
- Work begins upon receipt of the agreed deposit and either a signed contract or a written order confirmation.
- We offer unlimited design revisions until the client is fully satisfied, at no additional cost.
- Design approval must be confirmed via email. Any changes requested after approval may incur extra charges.
- Upon approval, we will begin development of the live site and the second installment of payment will be required.
- Feedback will be requested throughout the development process. Module testing may be conducted based on client input.
- The final website will be delivered once all requirements are fulfilled.
Warranty
We provide a 30-day warranty post-delivery covering minor bugs, content edits, functionality issues, and limited training/support. If issues arise within this timeframe, they will be resolved at no extra cost. After the warranty period, any further changes will be billed at £20.00/ AED 98.00 hour.
Timeline of the Development and Payment schedule
- A development timeline will be shared once the initial deposit is received.
- The first design draft will be delivered within 7 business days.
- Delays in client feedback may affect overall project completion timelines.
- The provided completion date is an estimate and not a fixed deadline.
- Clients will be informed of any delays along with valid reasoning from Extropy Media.
Content & Graphics Materials
- Clients are responsible for ensuring all provided materials comply with copyright laws. Extropy Media bears no liability for any infringement.
- Client-submitted data may be tested for web performance but must adhere to legal standards.
- Any content or imagery supplied by Extropy Media will be royalty-free.
Termination of Agreement & Refund Policy
- The client may terminate the agreement at any time, which will immediately halt development.
- If canceled within 7 days of deposit/payment, 50% of the deposit will be retained as service fees.
- If canceled after 7 days and prior to design approval, 100% of the deposit will be retained.
- Any remaining work can be requested. If canceled post-design approval, full payment is due.
- Extropy Media reserves the right to terminate the agreement and invoice in full if:
- Unlawful or unreasonable demands are made by the client.
- The client exceeds agreed financial or technical limits.
- No communication is received from the client for over 28 days.
- Payment delays exceed 14 days.
- All client instructions must be documented electronically (email or Word). Verbal instructions are not valid.
- Restarting a terminated project will incur new charges and full payment of the original contract.
Ownership
- All website assets remain the property of Extropy Media until final payment is completed. Ownership then transfers to the client.
- After the warranty ends, clients are responsible for backups. Extropy Media does not retain this data unless a maintenance plan is in place.
- All projects are branded and included in the Extropy Media portfolio.
- Clients may request brand removal for an additional fee.
- Clients wishing not to be showcased in our portfolio must send a written request.
Service & Maintenance
- Post-warranty support is available only under a purchased service plan.
- Without a service plan, the client assumes responsibility for any security or data issues.
- Extropy Media is not liable for malware or cyber-attacks.
- Support beyond the agreed period is chargeable.
Domain and Hosting Renewal
- Clients must renew their hosting/domain on time. Extropy Media is not responsible for data loss due to missed renewals.
- Client data will be retained for 14 days post hosting expiry.
- After this period, access and recovery of data may not be possible.
- Domain renewal post-expiry is not guaranteed.
- Renewal reminders will be sent 7 days before the due date.
Recurring Payments
- Recurring charges are billed monthly or annually based on selected services.
- Cancellations must be notified at least one month in advance.
- To cancel, email us with your details and instructions.
- Cancellation will be confirmed within 24-48 hours.
Control Panel & FTP
Extropy Media will provide all login credentials and backup instructions upon receipt of the final payment.
Third Party Expenses
Extropy Media is not liable for any external costs incurred by the client.
Missing Payments & Delaying Project
- We will notify the client of overdue payments or missing content.
- If payment is delayed, the client must provide an estimated timeline. Work may pause or the contract may be terminated under term 20.iv.
Communication
- If a client’s email address changes, Extropy Media must be notified via email—preferably from the previous email.
- If no response is received within 28 days of our email, the agreement will be terminated under term 20.iii.
